California Law Limiting Arbitration Resurrected by Ninth Circuit – Bloomberg Law

A California law aimed a limiting employers’ use of forced arbitration was partially revived by a divided Ninth Circuit, which held some of its provisions don’t clash with the federal law that govern agreements commonly used to keep disputes out of court.The Federal Arbitration Act doesn’t preempt portions of Assembly Bill 51 that prohibit employers from retaliating against workers who decline to sign arbitration pacts as a condition of employment, a U.S. Court of Appeals for the Ninth Circuit panel 2-1 ruled Wednesday.
